1. About these terms

These terms govern your use of the Thespotlightcircle website and booking platform. By submitting an enquiry you accept them. If you are enquiring on behalf of an organisation, you confirm you are authorised to do so.

2. Enquiries and holds

Submitting an enquiry is free and creates no contract. A hold reserves a date on an artist's calendar as a courtesy and may be challenged or released at any time before an offer is signed.

Fee ranges shown on the site are indicative only. They vary with market, date, capacity, routing and production requirements, and are not offers capable of acceptance.

3. Offers and confirmation

A booking is confirmed only when a written offer or contract has been signed by the buyer and countersigned on behalf of the artist, and any required deposit has cleared.

Thespotlightcircle acts as agent for the artist. The performance contract is between the buyer and the artist or the artist's furnishing entity unless expressly stated otherwise.

4. Fees, deposits and payment

Unless the contract says otherwise, a deposit of 50% of the artist fee is payable on signature, with the balance payable before the performance. Production, travel, hospitality and local costs are quoted separately and are the buyer's responsibility.

All amounts are exclusive of applicable taxes, withholding and bank charges. Currency risk sits with the buyer where a fee is contracted in a foreign currency.

5. Cancellation and force majeure

Cancellation terms are set out in each performance contract. Deposits are generally non-refundable where the buyer cancels.

Neither party is liable for failure to perform caused by events beyond reasonable control, including illness, travel restriction, government order, extreme weather or venue failure. The parties will use reasonable efforts to reschedule.

6. Buyer obligations

The buyer is responsible for the venue, licences, permits, security, insurance, crowd safety, and compliance with local law, and must meet the technical and hospitality requirements set out in the agreed rider.

7. Use of the site

You may not scrape, resell or republish roster data, imagery or fee information without written permission. Artist names, images and marks belong to their respective owners and are used with permission for booking purposes.

8. Liability

Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud. Subject to that, Thespotlightcircle's aggregate liability arising from a booking is limited to the commission actually received by Thespotlightcircle in respect of that booking. We are not liable for indirect or consequential loss, including lost ticket revenue or profit.

9. Changes and governing law

We may update these terms; the version in force at the time of your enquiry applies to it. These terms are governed by the laws of the State of Tennessee, and the courts of Nashville, Tennessee have exclusive jurisdiction, without limiting any different governing law agreed in a specific performance contract.
